Creator terms
In short: you share your link, your followers get a free month, and you earn 30% of what we receive from each one who goes on to pay, for their first 12 months. Either of us can end this with one month's notice. What you have earned is always paid.
1. Who this is between
These terms are an agreement between you (the creator) and Biojrnl Ltd, company no. 17290325, registered in England and Wales (“we”, “us”). They start when we send you your link and private code and you reply to accept them. You must be at least 18.
You work for yourself. Nothing here makes you our employee, agent or partner, and you can't make promises on our behalf.
2. What you earn
You earn 30% of the net revenue from each of your referred subscribers, for the first 12 months after their first payment. If they pay yearly, that is their first yearly payment.
A referred subscriber is someone who is new to the plan and redeems your offer code in the App Store or Google Play. People who get the app without redeeming your code can't be linked to you and don't count.
Net revenue is what Apple or Google actually pay us for that person's subscription, after the store's fee, VAT or sales tax, refunds and chargebacks.
Nothing is earned during the free month, or from someone who cancels before paying.
3. What doesn't count
We don't pay on sign-ups that come from:
- your own account, or accounts you or people working with you set up to redeem your code;
- paying or rewarding people to sign up, beyond the free month itself;
- paid search ads that use the name Biojrnl, unless we have agreed it in writing;
- anything misleading, including the claims ruled out in section 6.
If we find sign-ups like these, we take them out of your numbers and tell you why.
4. Your numbers
We count your numbers every Monday from the stores' own records and show them on the Creators page when you enter your private code. Keep that code to yourself. If you lose it, email us and we will replace it and switch off the old one.
If you think a number is wrong or a payment is missing, please tell us within 60 days of the payment date, while the store records are fresh. We will show you how we worked it out. Telling us later never loses you money you are owed.
5. Getting paid
- We pay monthly, within 10 working days of the stores paying us for that month. That is usually 5 to 7 weeks after the month ends, so the date on your page is an estimate until the money arrives.
- If a month comes to less than £20 (or $25, or €25), it carries over to the next payment.
- You see and are paid in your own currency: pounds, dollars or euros. The stores pay us in pounds, so we convert at our bank's rate on the day we pay you. Amounts already paid never change. We pay our bank's fees for sending it.
- We pay by bank transfer to an account in your name. You need to give us correct details.
- With each payment we send a statement showing what it covers.
- You are responsible for any tax on what you earn. Our amounts include any VAT you are required to charge: at 20% VAT, a payment of £30 includes £5 of VAT. If you are VAT-registered, send us a VAT invoice for each payment before we pay it.
If a payment we have already counted is later refunded or charged back, we take the commission you earned on it off your next payment. We never ask you to pay money back out of your own pocket, unless the sign-up broke section 3.
6. How you talk about Biojrnl
- Say it's an ad. Because you earn from your link, your post is an ad. Put “Ad” at the start of the post or caption, where people see it before they tap. Follow the advertising rules where you and your audience are, such as the ASA's CAP Code in the UK and the FTC's rules in the US, and your platform's own rules for paid partnerships. In a video, live or Story, say it or show it in the video itself as well, not only in the caption.
- No health claims. Biojrnl is a journal, not medical care. Don't say it diagnoses, treats, cures or prevents anything, or that it replaces a doctor.
- Be accurate. Only describe features the app has and the offer as it is.
- Use our name and images as given. Use the screens and logos in the creator kit and don't change them. Don't present yourself as Biojrnl or speak for us.
7. Followers' privacy
You see counts and amounts, never who signed up. We never share your followers' names, contact details or anything in their health record with you.
Your own details. We keep your name, email, bank details, your link and your numbers to run this agreement and pay you, and our payment records for tax. Only we, our bank and our accountant see them. We keep payment records for 6 years after your last payment, as UK tax law requires, and delete the rest when the agreement ends. Your rights over this data, and how to complain, are in our Privacy Policy.
8. Changes to these terms
We can change these terms by emailing you at least one month before the change starts. A change never reduces what you have already earned, or the 30% for 12 months on people who signed up with your code before the change. If you don't accept a change, you can end the agreement under section 9.
9. Ending it
- Either of us can end it by email, with one month's notice.
- We can end it straight away if you seriously break section 3 or 6, or keep breaking it after we have asked you to stop.
- When it ends, your link stops giving the free month and new sign-ups no longer count.
- You keep earning on people who signed up with your code before the end date, until their 12 months are up. If we ended it for a serious breach, you keep earning only on sign-ups the breach didn't touch.
- Everything you have earned is paid, including any amount under the minimum, which we pay with your last payment.
- Your private code keeps working until your last payment, so you can check every number.
10. Responsibility
Apart from paying you everything these terms say you have earned, our total responsibility to you is limited to the commission we paid you in the 12 months before the claim. Neither of us is responsible for losses the other could not have expected. Nothing here limits responsibility that the law does not allow to be limited.
The offer depends on the App Store and Google Play. If a store limits, changes or stops an offer code, we will tell you and agree a replacement with you where we can.
11. Law and contact
These terms are governed by the law of England and Wales, and its courts deal with any dispute we can't settle together. Write to [email protected] about anything here, and [email protected] for a formal notice.
